Overview

Tiffany is a partner in the Vorys Columbus office and the chair of the firm’s bankruptcy and creditors’ rights practice group.  She represents unsecured creditors, secured creditors, trustees, creditors’ committees and other parties in interest in chapter 11 reorganization cases, chapter 7 cases and in related litigation on a national basis and has acted as co-counsel on an international basis.

Platform Life Science Inc., et al. adversary proceeding in the In re FTX Trading Ltd., et al. bankruptcy case in the United States Bankruptcy Court for the District of Delaware (Dorsey, J.), in which the aggregate amount in controversy is over $71 million
  • Counsel to global media company in contested matter in the In re Vice Group Holding Inc. bankruptcy case in the United States Bankruptcy Court for the Southern District of New York (Mastando III, J.) resulting in assumption, assignment and cure of executory contract
  • Counsel to DIP lender in the In re Volunteer Energy Services, Inc. chapter 11 bankruptcy case filed under the complex chapter 11 procedures in the United States Bankruptcy Court for the Southern District of Ohio (Preston, J.)
  • Litigation counsel to the post-confirmation Trustee of the Advantage Rent A Car Unsecured Creditor Trust in the In re Advantage Holdco, Inc. (f/k/a Advantage Rent-a-Car) bankruptcy case in the United States Bankruptcy Court for the District of Delaware (Horan, J.), pursuing over 90 demands and associated litigation to avoid and recover alleged preferential transfers
  • Counsel to the Official Committee of Unsecured Creditors in the In re Murray Energy Holdings Co., et al. bankruptcy case in the United States Bankruptcy Court for the Southern District of Ohio (Hoffman, J.)
  • Lead litigation counsel to financial institution defendant in defense of trustee fraudulent transfer and related claims seeking to avoid and recover hundreds of millions of dollars in connection with the PEAKS Loan Program in the In re ITT Educational Services, Inc. bankruptcy case in the United States Bankruptcy Court for the Southern District of Indiana (Carr, J.)
  • Represents plastics company in defense of fraudulent transfer litigation brought by federal receiver over RaPower-3, IAS and LTBI pending in the United States District Court for the District of Utah (Nuffer, J.)
  • Represented Fortune Global 500 company in defense of avoidance action brought by the Litigation Trust for Northstar Offshort Group, LLC, involving Ponzi-scheme allegations and Section 546 safe-harbor defenses, in the In re Northstar Offshore Group, LLC bankruptcy case pending in the United States Bankruptcy Court for the Southern District of Texas (Isgur, J.)
  • Represented largest OEM customer in the In re TK Holdings Inc. (Takata) chapter 11 bankruptcy case in the United States Bankruptcy Court for the District of Delaware (Shannon, J.)
  • Represented senior secured creditor in In re Woodbury Outfitters chapter 11 bankruptcy case in the United States District Cout for the Southern District of Ohio (Hoffman, J.)
  • Represented back up bidder in the In re Heritage Home Group LLC bankruptcy case in the United States Bankruptcy Court for the District of Delaware (Gross, J.)
  • Served as post-confirmation litigation counsel to plan trustee of the liquidating trust in the In re USA Discounters, Ltd. bankruptcy case pending in the United States Bankruptcy Court for the District of Delaware (Sontchi, J.)
  • On behalf of bank defendants, successfully rebutted the presumption of insolvency at trial in a multimillion-dollar preference action in the In re American Classic Voyages bankruptcy case in the United States Bankruptcy Court for the District of Delaware, and later obtained affirming decision from the United States District Court for the District of Delaware, resulting in zero liability for bank clients (Carey, J.)
  • Served as litigation counsel to Liquidating Trustee of the Triad Liquidating Trust in the In re Triad Resources, Inc. bankruptcy case in the United States Bankruptcy Court for the District of Ohio (Preston, J.)
  • Routinely represents chapter 7 trustees in contested matters and adversary proceedings

Tiffany regularly speaks at national and regional conferences, most recently on the topic of Third Party Releases at the Bankruptcy Bench-Bar Conference of the Southern District of Ohio, Inc.  She has also spoken at the at the American Bankruptcy Institute's Mid-Atlantic Bankruptcy Workshop in Hershey, Pennsylvania and to the Association of Corporate Counsel in Columbus, Ohio.

Tiffany received her J.D. from Washington University School of Law and her B.A. with highest honors from Principia College.

In 2022, Tiffany completed an intensive mediation program, Mediating the Litigated Case, at the internationally recognized Straus Institute for Dispute Resolution at the Pepperdine Caruso School of Law, where she studied the mediation of litigated cases.  In 2020, Tiffany served as a court-appointed Member of the Mediation Project Committee for the United States Bankruptcy Court for the Southern District of Ohio, on which she participated in developing the court’s current mediation procedures, and after which she joined the list of court-approved mediators.  She is passionate about the mediation process and looks for opportunities to mediate a variety of commercial disputes.
