Allen Kinzer and Jonathan Stock, attorneys in the Vorys Columbus office, authored an article for AreaDevelopment titled “The Legal Limits of DEI in Incentives Agreements, Hiring and Contracting.”
The article examines how a recent executive order from the Trump administration could impact state and city-level development incentives that are tied to diversity, equity and inclusion (DEI) goals. It focuses on case law that provides guidelines for interpreting ambiguous language in the executive order.
“President Trump issued an executive order prohibiting federal contractors from engaging in ‘illegal DEI.’ However, there is no formal definition of ‘illegal DEI’ or ‘legal DEI.’ Based on case law, there are some boundary lines.”
