Shaw Quoted in MJBizDaily Story on Pre-Legalization Cannabis IP Protection 

Jabari Shaw, an associate in the Vorys Cincinnati office and a member of the firm’s intellectual property group, was quoted in a MJBizDaily article titled “How US cannabis breeders can protect their IP before legalization.” 

Shaw discussed the effort and resources to demonstrate the necessary distinctness, uniformity and stability required for a product to qualify for IP protections.  Still, the value in a brand’s distinct genetic offerings may encourage smaller breeders to pursue IP protections.

“Because of federal illegality and hemp bans, some people are starting to say wait and see how it plays out, while the other half is saying let’s do what Aurora (a Canadian multinational breeder) is doing,” Shaw said.

The article additionally examined legal strategies that that cannabis breeders can pursue, including patents through the U.S. Patent and Trademark Office and others.
