Miller Quoted in Law360 Story Titled “Ohio Justices Rule Land Takings Settlement Is Enforceable”

Joe Miller, a partner in the Vorys Columbus office, was quoted in a Law360 article on the Ohio Supreme Court decision regarding the Ohio Department of Transportation not maintaining the terms of its settlement with Ice House Ventures LLC, Lion Management Services LLC and Smokestack Ventures LLC, also known collectively as "IHV."  According to the story, the department and IHV struck a deal in 2018 when the department sought to claim some land that was owned by IHV to improve an interstate. The Ohio justices unanimously ruled in favor of IHV.

The story states:

"Joseph Miller, counsel for the IHV businesses, called the justices' ruling an important decision for all who do business in the Buckeye State in a statement to Law360, noting that the Ohio Chamber of Commerce had filed an amicus brief urging the justices to deem the settlement enforceable for that reason.

'We are pleased that a unanimous Supreme Court of Ohio upheld basic principles of contract law and did not allow the Ohio Department of Transportation to evade its obligations under contract and court order through after the fact arguments that don't square with the facts or longstanding Ohio law,' Miller said."
