Vorys partner Kelly Bissinger served on a panel for a webinar titled "Traps for the Unwary: Acquisition Credit Structuring Issues" on January 26th, 2023.
The panel discussed a wide range of topics related to acquisition credits beginning with an overview of the acquisition credit rules and a deeper dive into more advanced topics such as what constitutes “substantially assisted” for purposes of the 10-year rule exception, who’s “related” to the seller and how do you document that, timing of acquisitions and how to avoid issues when purchasing a project early, appraisals and valuation and what to do about over-income tenants.
