Vorys hosted the webinar Year in Review: Our Top IP Developments of 2017 on January 31, 2018, from 12-1:00 p.m. Iona Kaiser, Bill Oldach, Tanya Curcio and Laura Geyer from the Vorys IP team presented. Topics covered included updates for patent, trademark, copyright and relevant litigation, including:

  • As applied to domestic corporations, residence in § 1400(b) refers only to the State of Incorporation
  • Ban on "offensive" trademark registrations ruled unconstitutional
  • "Google" is not generic for searching
  • Laches cannot be invoked as a defense against a claim for damages brought within §286’s six-year limitations period
  • Still no registration for marijuana-related goods/services
  • A patentee’s decision to sell a product exhausts all of its patent rights in that item, regardless of any restrictions the patentee purports to impose.
  • Adult themed play about the life of Cindy Lou Who after her encounter with the Grinch who stole Christmas deemed fair use
