Wesley R. Abrams

Wes is a partner in the Vorys Cincinnati office and member of the firm’s litigation and appellate groups.  He represents Fortune 500 companies, national banks, small businesses and individuals in high-stakes commercial disputes and class actions.  He handles trials, appeals and arbitrations across the country.

Wes’s practice spans a broad range of commercial, consumer, fiduciary and regulatory matters.  He defends national banks and retailers in consumer class actions, large corporations in substantial contract disputes, and healthcare insurers in reimbursement and ERISA litigation.  He represents plaintiffs in consumer class actions, healthcare providers on the other side of reimbursement disputes and individuals in fiduciary litigation involving closely held businesses and trusts.  He handles corporate and government investigations and False Claims Act claims.

Wes draws on his work across these areas to assess the strengths and risks of each case and help clients make informed decisions about settlement, trial and appeal.  He distills complex facts and legal issues into clear advice and practical solutions for businesses and individuals.

Career highlights include:

• Obtaining judgment following a bench trial for a national bank in a post-acquisition dispute over contractual indemnification and escrow rights, defeating the seller’s claims and prevailing on the bank’s counterclaims.
• Defeating class certification in a putative nationwide action challenging a national retailer’s grocery advertising and seeking hundreds of millions in damages.
• Securing dismissal of a putative consumer class action over a financial institution’s mobile banking services and drafting the briefs that led the Sixth Circuit to affirm.
• Obtaining judgment on the pleadings for an oil-and-gas client, defeating a contract claim for more than $6 million and reducing exposure under several “take-or-pay” contracts.
• Resolving a seven-figure Medicaid reimbursement dispute for a regional hospital system and securing changes to a large managed care organization’s retroactive audit process for the client.
• Drafting appellate briefs that secured reversal of a property tax ruling against a national retailer. The published Kentucky Court of Appeals decision established additional safeguards for taxpayers challenging real property assessments at administrative hearings.
• Drafting appellate briefs that led to favorable results for clients in the Fifth, Sixth, Ninth, and Tenth Circuits.

Wes received his J.D. summa cum laude from the Northern Kentucky University Chase College of Law, where he was executive editor of the Northern Kentucky Law Review.  He received his B.S. with highest honors from the University of Louisville.
