Jessica Hernandez Diotalevi

Jessica is of counsel in the Vorys Orange County office and a member of the firm’s litigation group.  She has nearly two decades of experience counseling and litigating and trying complex cases, in business, labor and employment, finance, intellectual property, health care, toxic tort, and product liability.  Jessica has represented brands and clients in the sports, retail, technology, entertainment, energy, manufacturing and construction industries in both state and federal courts. 

Jessica has led trial teams in cases involving breach of contract, false advertising, wrongful death, defamation, entertainment distribution rights, revenue sharing and more.  She is experienced at litigating both personal and class action matters.

Jessica has significant experience with depositions, having taken and defended more than 140 depositions, including C-suite representatives of large corporations, high-profile witnesses, subject matter experts and percipient witnesses.

• Successfully defended major professional sports team in months-long, high-profile wrongful death trial
• Served as national discovery counsel to major Japanese product manufacturer
• Obtained nominal award damage verdict after successfully defending health and wellness material sciences company in federal court trial
• Represented large technology company in several breach of contract and fraud actions
• Represented Hollywood film production, finance, distribution and sales company in action brought by foreign distribution company
• Successfully defended national specialty construction and infrastructure company in a Colorado state court trial
• Represented international gig economy company in various negligence and fraud actions
• Represented international beauty and skin care manufacturer in several single plaintiff and multi-plaintiff negligence and toxic tort actions
• Successfully defended major domestic and international product manufacturer in trial involving complex engineering and metallurgical issues
• Obtained summary judgment for chemical producer in toxic tort action
• Represented large European product manufacturer in multi-million-dollar product liability action

Jessica received her J.D. from the University of Southern California School of Law, where she was a staff member for the Southern California Review of Law and Social Justice.  She received her B.A. from the University of California, Los Angeles.
