Vorys has a long history of involvement in the development and implementation of the Clean Water Act and Safe Drinking Water Act at both federal and state levels. One of our partner’s service in Washington, D.C. included work on the initial Clean Water Act legislation. That involvement continued through historic and current federal regulations, state statutes, and state regulations. Today, we represent a wide variety of companies, governments, and individuals regulated under the key water laws and their complex maze of regulations and guidance.
Examples of the wide variety of water law issues we advise clients on include:
- NPDES permitting for large and small industrial facilities, municipal sewer systems, and airports
- Litigating federal, state, and local enforcement under Clean Water Act and state laws
- Litigating, negotiating settlement, and advising on compliance with judicial Consent Decrees on water issues, including multi-billion dollar CSO/SSO projects
- Wetland permitting and enforcement involving oil and gas facilities, homebuilders, farmers, and other landowners
- Stormwater permit drafting and negotiation, plus development of regulations and best management practices for local stormwater districts, developers and industry
- Storm Water Pollution Prevention Plan assistance
- Drafting of federal, state and local legislation and regulations on sewage treatment, use of green infrastructure, stormwater management, and enforcement response
- Defense of citizen suits brought under the Clean Water Act
- Frequent speaking to government officials and industry leaders on water law issues
- Representation of local water districts and other public water providers in litigation, rule-making, and other issues
- Organization and re-organization of sewer districts and water districts
- Special Prosecutor to County to address human and animal waste impacts
- Great Lakes Water Quality rule-making, permitting, and sediment remediation
- Key involvement in several Ohio water statutes and regulations, including those on Antidegredation, Permit Limits below Qualification Level Procedures, and Sewer Line Review
