The Laches Defense in Fiduciary Litigation

Dainel J. Buckley, a partner in the Vorys Cincinnati office, co-authored an article entitled “The Laches Defense in Fiduciary Litigation” for the March/April 2011 edition of the Probate Law Journal of Ohio.  In the article, Buckley and his co-author Phillip J. Smith, an attorney with GE Aviation, say that the defense of laches remains an important potential defense following the enactment of the Ohio Trust Code.  The authors state that “Counsel who litigate fiduciary issues will do well to give this defense thoughtful consideration in presenting and defending claims.”
