Welsh Quoted in WorkCompCentral.com Story Titled “Worker Can't Get PTD and PPD Benefits for Different Injuries in Same Claim”

Rosemary Welsh, an attorney in the Vorys Cincinnati office, was quoted in a WorkCompCentral.com story titled “Worker Can't Get PTD and PPD Benefits for Different Injuries in Same Claim.” The story was focused on a recent Ohio Supreme Court decision that found a worker who's already receiving permanent total disability benefits for a psychological injury can't also claim a permanent partial disability claim for physical injuries.

The story states:

She said Friday that she believed the Supreme Court decision served to clarify any perceived inconsistencies in Ohio's case law and that it established that the commission cannot award an injured worker PPD benefits when there has been a prior award of PTD benefits in the same claim.

Welsh said she thought the court's decision ‘may be expected to reduce claim costs for Ohio employers.’

She added that employers and employees now can expect the court ‘to take a very close look at the statutory authority for the commission’s actions and not allow lower courts to read into the workers’ compensation statute something that cannot reasonably be implied from its language.’”
