Clean Air Act Permitting and Enforcement

Our attorneys have broad, extensive experience in representing clients in matters involving the Clean Air Act (CAA). We assist clients in all manners of air permitting, including major source permitting under the Prevention of Significant Deterioration (PSD) program and nonattainment New Source Review (NSR). We have extensive experience in helping clients manage their obligations under the hazardous air pollutant (HAP) requirements of the CAA, including compliance with Maximum Achievable Control Technology (MACT) standards and establishing synthetic minor permits to avoid MACT. In tackling these problems, we emphasize strategic planning with our clients in order to minimize their regulatory obligations and enforcement risk.

We defend manufacturing facilities in state and federal Clean Air Act enforcement actions. Our attorneys also actively participate in rule and permit initiatives.
