Joseph M. Schreiber
Mr. Schreiber is an associate in the Vorys Houston office and a member of the litigation group. Mr. Schreiber has significant experience in toxic and mass torts litigation including claims for personal injury due to asbestos and chemical exposure, pharmaceutical cases, and tread separation litigation. Mr. Schreiber has also focused on commercial litigation, including breach of contract, copyright litigation, and construction litigation. He also has experience in internal investigations. He has represented clients in the architectural, auto, chemical, energy, construction, pharmaceutical and rubber industries on both the plaintiff and defendant sides. Mr. Schreiber has handled cases in trial courts, arbitrations, and courts of appeal.
His notable experience includes:
- Co-trial counsel to three-judge arbitration panel winning multi-million dollar valuation dispute involving recycled aggregates, including cross-examining other side’s expert and key fact witnesses and presenting client’s key fact witness and expert at arbitration trial
- Co-trial counsel to three-judge arbitration panel winning multi-million dollar dispute in a post-closing purchase price adjustment in the sale of a construction company, including presenting and cross-examining key witnesses at arbitration trial
- Co-trial counsel in jury trial defending claims of breach of partnership agreement, breach of contract and unjust enrichment
- Trial counsel defeating injunction and forcing dismissal of $11 million business tort claims regarding sale and disputed ownership of real estate
- Winning summary judgment on seven consolidated asbestos cases and leading general-issue argument for more than 40 defendants against 69 plaintiffs
- Obtaining dismissal of all claims and defeat of proposed injunction in $11 million business tort case involving disputed ownership and possession of real property
- Successfully defending a $14 million indemnity claim for alleged personal injury, forcing dismissal of all defendants
- Prosecuting a copyright infringement claim in federal court as attorney of record and obtaining settlement for original demand within five months
- Lead associate and primary handling attorney in multi-million dollar alleged breach of construction contract case involving a chlor-alkali plant. Representation included all document production and discovery, witness interview and deposition presentation and taking depositions of key opposing witnesses
- Developed and implemented strategy to force a change in the Travis County Standing Order on service of process in asbestos cases; succeeding in six months where others had failed for years
- Defeated multiple motions for temporary restraining orders
Mr. Schreiber presented "Surviving the Maelstrom,” a guide to pretrial investigation and case preparation; given to the National Petroleum Energy Credit Association in San Antonio, Texas in April 2009.
Mr. Schreiber is a member of the Houston Bar Association and is admitted to practice in all State and Federal courts in the State of Texas. He received his J.D. with honors from The University of Texas School of Law, and his B.A. cum laude from Macalester College.
