Mr. O’Malley is a partner in the Vorys Cleveland office and a member of the litigation group.  His trial practice focuses on business and health care litigation.  On behalf of businesses and individuals, Mr. O’Malley has served as lead counsel in cases arising under ERISA, the Racketeer Influenced and Corrupt Organizations Act (RICO), the National Bank Act, the Bank Holding Company Act, lender liability laws, state and federal antitrust laws and federal securities laws.  He has represented clients in arbitration before the American Arbitration Association (AAA) and regularly serves as lead counsel in defense of companies in class actions.  His class action experience includes matters arising under Ohio’s mortgage, insurance, consumer and banking laws.  Mr. O’Malley has also been lead counsel in class actions arising under RICO, ERISA and federal banking laws.

Career highlights include:

• Extensive class action defense practice for various national banks
• Serving as outside trial counsel for an academic medical institution in contracting, medical staff, regulatory and other health care related issues
• Representing claimant in an arbitration and securing a recovery of $14,400,000
• Securing victory for an antitrust defendant in a dealer termination case before United States District Court for the Northern District of Ohio and United States Court of Appeals for the Sixth Circuit
• Successfully defending, in trial, a closely held corporation in fraudulent conveyance litigation

Mr. O’Malley is a member of the Ohio State Bar Association and the Cleveland Bar Association.

Mr. O’Malley has given numerous presentations on attorney-client privilege and work product immunity, internal corporate investigations, criminalization of civil conduct, class action defense strategies, trends in medical staff relations and False Claims Act strategies.

Mr. O’Malley received his J.D. from Case Western Reserve University School of Law where he was Articles Editor of the Case Western Law Review.  He received his B.A. cum laude from John Carroll University.
